Urinating in general public not a criminal offense, states Sweden

The Local, an English-language newspaper in Sweden, most recently reported that a 45-year-old man avoided a penalty for public peeing. The Nacka resident challenged his penalty for public urination, and also the Stockholm court found his level of discretion merited a dismissal of the fine.

Open public urination begins with the Nacka judgment

Most people have the capability to urinate in general public – assuming an elaborate catheter isn’t required – however the vast majority fears either general public censure or the long arm of the law. According to Metro, a Swedish newspaper, 5,000 Swedes relieved themselves in general public in 2009 despite it being against the law in Sweden which means a 800 kroner, or $120, is fined to them.

Everything changes though. It changed because of Sweden’s Nacka ruling. The judgment said that Swedes may not be fined for peeing in public. It has to be an emergency though. Public urinators can be freed by the Swedish court as long as all body parts are covered, the person looks for a toilet before doing it, and as long as there is no blatant general public exposure. The Spring Break Stockholm crowd probably doesn’t mind the legal precedent, but the Swedish police force may have to deal with something interesting now. Where does a cop draw the line? When it is time to stop it?

Court is saying the ‘Intent to upset was lacking’

Court Annika Johansson was the judge of the Stockholm district over the Nacka resident case which is why she was in a position to say that that the resident wasn’t inherently offensive and didn’t mean to upset people. There weren’t any public toilets within the area where the man was waiting for a bus to come. He went behind the bus stop façade when he decided he couldn’t wait anymore. Evidently he was not intoxicated and conducted himself as discretely as possible under the circumstances.

America is watching. Pay close attention. It is possible to interpret a law reasonable when observing it nevertheless.
